Deriv Capital Contracts & Currencies L.L.C
Deriv Capital Contracts & Currencies L.L.C ("Deriv") is licensed and regulated by the UAE Capital Market Authority (CMA) as a Category 1 Trading Broker for Over-the-Counter Derivatives Contracts and Currencies Spot Markets and Financial Products Dealer (licence 20200000243), and as a Category 5 Financial Consultant (licence 20200000199).
This policy sets out how we select creators who promote Deriv in the United Arab Emirates. It meets the requirements of Article 6(3) of CMA Resolution No. (10/R.M) of 2025 on the Regulation of Finfluencers.
It covers anyone we engage to publish content about Deriv to audiences in the United Arab Emirates — whether they describe themselves as a creator, an influencer, an educator, or a marketing partner. We assess them based on the content they will publish, not how they describe themselves.
What we check before engaging a creator
Type of content. We first establish what the creator will publish. Creators who share Deriv-approved or factual content are assessed differently from those who create their own financial analysis, opinions, or recommendations. A creator may only publish the type of content they have been approved for.
Permits and registration. Every registered creator/finfluencer we work with must hold a valid Advertiser Permit issued by the UAE Media Council, and must publish only through accounts registered with the Council. We verify these details and check that they remain valid. Creators who publish their own financial recommendations must also be registered with the CMA, including for the specific channels they use. We record any restrictions on their permits or registrations and require them to notify us of changes.
Identity and account ownership. We verify each creator's legal name and identity and confirm that they own and control the accounts they will use for the campaign to publish from. Content must be created and published by the approved creator.
Honesty, integrity, and compliance history. We want to work with creators our audience can trust, so we consider their regulatory, legal, and integrity history before we engage them.
Competence. Where a creator is registered with the CMA, we record the basis on which they qualified and the evidence for it.
Independence and conflicts of interest. Where a creator provides a financial recommendation, applicable conflicts and compensation must be disclosed to the audience in the content itself, and kept up to date when circumstances change.
Where a creator also earns commission through a referral or affiliate link, we require them to disclose to the audience that we pay them both for the content and the commission arrangement. One disclosure is not a substitute for the other. Commission is never structured so as to reward a referred client depositing more or trading more often.
Audience. We consider who the content is likely to reach, including their age and location. We do not target anyone under 18 with content about our products.
How we decide
Audience reach and engagement may form part of our assessment, but every creator must meet the standards above before we engage them. Commercial considerations do not override these requirements.
Our marketing team carries out the screening and verification. The final decision to engage a creator and to approve their content for publication rests with an authorised individual who is accountable to our Compliance function. Compliance receives regular reports on creator engagements and content decisions, including where a decision overrides an automated recommendation and why.
We remain responsible for the content published on our behalf, including what it says and how it is distributed. We do not transfer that responsibility to a creator.
What we require of published content
We review and approve content before it is published to make sure it meets applicable legal and regulatory requirements. This review cannot be waived.
Content published on our behalf must:
- Clearly identify Deriv, our regulated status, and the services we are licensed to provide.
- Be clear, fair, and not misleading.
- Clearly communicate the high-risk nature of our products.
- Not contain forecasts or statements about future performance.
- Not provide personalised advice or promise or imply profits.
- Be published to the public, not directed at individuals.
Creators who publish their own financial recommendations must also include all disclosures required by the CMA, including their registration details, the date and time of relevant prices and recommendations, their sources, and any interests or conflicts.
Creators must not act as a prospective client’s point of contact with Deriv or help them open or verify an account. These are separately regulated activities and are not part of our creator arrangements.
Ongoing obligations
Our checks do not end when a creator is engaged. Throughout a campaign, we monitor published content, audience interactions, and the status of relevant permits and registrations.
We may require content to be corrected, relabelled, paused, or removed at any time if it becomes inaccurate, outdated, misleading, or non-compliant.
If a creator starts publishing content beyond what they were approved for, we pause the campaign and reassess them.
We retain campaign records, approvals and content for the period required by the Financial Activities Rulebook, and we archive all marketing material published on our behalf.
Complaints
If you believe content published by a creator on Deriv's behalf does not meet these standards, contact us at complaints@deriv.ae. We will investigate and respond.
You can also raise concerns about compliance with the finfluencer regulations with the UAE Capital Market Authority, or concerns about social media advertising with the UAE Media Council.
Review
We review this policy at least once a year and whenever the applicable requirements change.
